WEBSITE FILE RELEASE, ACCEPTANCE & FINAL ACKNOWLEDGMENT
This Website File Release, Acceptance & Final Acknowledgment (“Agreement”) is entered into between:

1. WEBSITE ACCEPTANCE
I, Peter Ithier, on behalf of Eyes Wide Open Vending, acknowledge that I have had the opportunity to review and inspect the website located at:
https://eyeswideopenvending.com
I confirm that I am satisfied with the website in its current condition and accept the website AS IS as of the date of this Agreement.
I further acknowledge and agree that:
The website has been presented to me for final review.
I have had the opportunity to request revisions, corrections, or changes.
I am satisfied with the design, content, layout, functionality, and overall completed website.
No further changes, modifications, revisions, additions, or corrections are required from Geografixx.
I voluntarily accept the website in its present condition as the completed and final version of the project.
My signature below constitutes my final approval and acceptance of the website.
2. RELEASE OF WEBSITE FILES
At the Client's request, Geografixx will release and/or provide the available website files, database, content, images, and other website-related materials in its possession associated with:

The files released may include, where applicable:
WordPress website files
Website database
Images and uploaded media
Theme files
CSS and JavaScript files
Custom website code
Website content
Plugin-related files
Database backup or export
Other website files maintained by Geografixx
The Client acknowledges that certain software, plugins, themes, services, licenses, subscriptions, APIs, hosting services, or third-party products may be subject to separate licensing requirements and may not be transferable.
3. CLIENT ASSUMES FULL RESPONSIBILITY
Upon release, delivery, transfer, or provision of access to the website and/or website files, Peter Ithier and Eyes Wide Open Vending assume full responsibility for the website and all associated files.
The Client accepts responsibility for, including but not limited to:
Website hosting
Website maintenance
Website security
Website backups
Software and plugin updates
Theme updates
Server configuration
PHP and database compatibility
SSL certificates
DNS configuration
Email configuration
Website functionality
Website availability and uptime
Malware protection
Data protection
Future modifications
Third-party integrations
Payment systems
Compliance requirements
Once the website or website files are released or transferred, Geografixx shall not be responsible for any subsequent website malfunction, downtime, loss of data, security issue, malware infection, compatibility problem, server problem, broken functionality, modification, or other issue resulting from the actions or omissions of the Client, another developer, hosting company, third party, software provider, or service provider.
The Client assumes responsibility for the website from the time of release or transfer.
4. RELEASE OF GEOGRAFIXX FROM FUTURE RESPONSIBILITY
The Client acknowledges that after the website and/or files are released, Geografixx will no longer have control over the environment in which the website is hosted, maintained, modified, or operated.
To the fullest extent permitted by law, the Client agrees to release and hold Geografixx harmless from claims, damages, losses, expenses, or liabilities arising from changes, hosting, maintenance, security, operation, or management of the website occurring after the website has been released or transferred.
Any future services requested from Geografixx after execution of this Agreement may be considered new work and may require a separate agreement and additional charges.
5. NO REFUNDS
The Client acknowledges that the website project and services provided by Geografixx have been performed and delivered.
By signing this Agreement, the Client confirms satisfaction with and acceptance of the completed website.
Accordingly, all payments previously made to Geografixx for the website, website development, design, hosting, programming, marketing, consulting, or related services are final and non-refundable to the fullest extent permitted by applicable law.
The Client agrees that no refund, reimbursement, credit, or return of previously paid fees is owed as a result of accepting the website or requesting the release or transfer of the website files.
6. AGREEMENT NOT TO DISPUTE OR CHARGEBACK AUTHORIZED CHARGES
The Client acknowledges that all charges previously authorized and paid to Geografixx for services actually performed were knowingly and voluntarily authorized.
To the fullest extent permitted by applicable law and applicable payment-network rules, the Client agrees not to initiate, request, or pursue a chargeback, payment reversal, or payment dispute for authorized charges relating to services that have been performed and accepted under this Agreement.
The Client further acknowledges that this signed Agreement may be provided to a bank, credit-card issuer, payment processor, merchant processor, or other financial institution as evidence that:
The services were provided.
The website was delivered.
The website was reviewed and accepted by the Client.
The Client stated that they were satisfied with the website.
No further changes were required at the time of acceptance.
The Client agreed that payments for completed and accepted services are non-refundable.
Nothing in this provision is intended to waive any right that cannot legally be waived or to prohibit a legitimate claim involving an unauthorized or fraudulent transaction.
7. WEBSITE ACCEPTED “AS IS”
The Client specifically acknowledges and agrees that:
I AM SATISFIED WITH THE WEBSITE AND NO FURTHER CHANGES ARE REQUIRED. I ACCEPT THE WEBSITE IN ITS CURRENT CONDITION AND AGREE TO TAKE THE WEBSITE AS IS.
The Client understands that once this Agreement is signed and the website files are released, any additional changes, revisions, repairs, updates, modifications, or technical assistance requested from Geografixx are not included in the completed project unless separately agreed to in writing.
8. THIRD-PARTY SOFTWARE AND LICENSES
The Client understands that the website may utilize third-party:
WordPress plugins
Themes
Fonts
Stock photography
APIs
Software
Security services
Hosting services
Backup services
Premium licenses
Subscription services
The release of website files does not necessarily include ownership or transfer of licenses owned or maintained by Geografixx.
The Client may be required to purchase independent licenses or subscriptions to continue receiving software updates, premium features, technical support, security updates, or other services.
9. BACKUPS AND DATA
The Client is responsible for maintaining copies and backups of all website files after they are released.
Geografixx is not obligated to retain website files, databases, backups, emails, or other information indefinitely after the website is transferred or services are terminated.
The Client acknowledges that Geografixx may delete archived website files and backups after completion of the transfer.
10. FINAL PROJECT COMPLETION
By signing below, the Client confirms that the website project is considered completed and accepted.
The Client confirms that, as of the date of signature:
The website has been reviewed.
The website is accepted.
The Client is satisfied with the completed website.
No additional website changes are required.
The Client accepts the website as is.
The Client accepts responsibility for the website following its release.
Payments for completed and accepted services are non-refundable to the fullest extent permitted by law.
The Client agrees not to dispute or charge back authorized charges for services performed and accepted, subject to applicable law and payment-network rules.
